Certificate of Nonexistence of Record Apostille

February 2, 2023 by Admin

Do you need to apostille your Certificate of Nonexistence of Record issued by Homeland Security (USCIS)?

A Certificate of Nonexistence of Record is a document issued by the U.S. Department of Homeland Security (DHS) that states that DHS has no record of the person named in the certificate having been admitted to the United States as a permanent resident or having been issued a certificate of naturalization. This certificate may be requested for various reasons, including for use in immigration proceedings, for proof of U.S. citizenship, or for personal reasons. The certificate provides a formal statement from DHS indicating that there is no record of the person in question having been granted certain immigration benefits.

Below is an example of a Certificate of Nonexistence of Records issued by the US Department of Home Security (USCIS):

How do I obtain dual citizenship with Italy?

To obtain dual citizenship with Italy as a U.S. citizen, you must first meet the eligibility requirements for Italian citizenship. In general, you may be eligible if:

  1. You have Italian ancestry: You may be able to claim Italian citizenship through your Italian-born ancestors, even if they emigrated from Italy many years ago.
  2. You are married to an Italian citizen: If you are married to an Italian citizen, you may be eligible for Italian citizenship after a certain period of time living in Italy.
  3. You have lived in Italy for a certain period of time: If you have lived in Italy for a certain period of time, you may be eligible for Italian citizenship.

Once you have determined that you are eligible for Italian citizenship, you will need to apply for citizenship through the Italian consulate in the U.S. The process of obtaining Italian citizenship can take several months or even years, and it may require providing proof of eligibility and completing various forms and interviews.

You may be asked to apostille various documents including:

  • Certificate of Nonexistence of Record
  • Birth Certificates
  • Marriage Certificates
  • Death Certificate
  • Divorce Decree
  • FBI Background Check

It’s important to note that obtaining dual citizenship with Italy may have implications for your U.S. citizenship, as the U.S. government recognizes dual citizenship but may consider a dual citizen to be solely a citizen of the foreign country in certain circumstances. Before pursuing dual citizenship, it is recommended to seek the advice of an immigration attorney to understand the potential implications.

Certificate of No Impediment for Marriage and Apostille

January 31, 2023 by Admin

Do you need to apostille your Certificate of No Impediment for Marriage?

A Certificate of No Impediment for Marriage (also known as a “Single Status” or “Certificate of No Record of Marriage”) is a legal document issued by the local County Clerk’s office that certifies that there is no legal obstacle to a person getting married in a foreign country (Example: Mexico, Vietnam, Ethiopia, etc…). This certificate is typically required for Americans who wish to get married in a foreign country, or for citizens of a country who wish to get married in another country. The certificate typically includes the person’s name, birth date, citizenship, and other identifying information, as well as a statement attesting that there is no record of the person being married or having any other legal impediment to getting married. The certificate is usually issued by a government agency , such as the local County Clerk’s office. It must be signed by the official issuing the certificate before the state will issue the apostille.

We can apostille documents issued from all 50 U.S. states, District of Columbia, and the U.S. Federal Government (USA Embassy Single Status). For countries who are non-members of the Hague Apostille Convention, we can also process your documents through the U.S. Department of State and the Embassy or Consulate office (Legalization Process).

Note: This document may also be referred to as:

  • No Record of Marriage Apostille
  • Certificate of Freedom to Marry Apostille
  • Certificate of No Impediment for Marriage Apostille
  • Certificate of No Record – Marriage
  • Affidavit of Single Status
  • Affidavit of Marriageability
  • Certificate of No Public Record
  • Eligibility to Marry
  • Affidavit of Civil Status

The first step is to contact the local County Clerk’s office to request a document that states you are currently not married.  Most all County Clerk offices can provide you this document so please be sure to speak to a supervisor if you are told otherwise.  A document issued from the County Clerk’s office does NOT require notarization.  If the County Clerk is unable to assist you, thy the next closest County Clerk office.

If you are outside of the United States, the local US Embassy or US Consulate office should be able to assist you in completing a single status and also having it signed and notarized.  Because you will be visiting a U.S. Federal Government office and having your document signed and notarized by a US Federal notary public, this document can then only be apostilled through our Washington DC apostille office.

Obtaining an apostille for your certificate of no impediment for marriage can be complicated and time-consuming. Don’t leave this process to untrained employees or non-professionals who do not fully understand the apostille process and the unique requirements of certain countries. Your paperwork could be rejected costing you time and money. Don’t let this happen to you!

Our staff is available Monday-Saturday from 9am to 6pm to answer your questions and provide you easy to follow-step-by-step instructions.  Please call us at 1-800-850-3441.

Spain Golden Visa and Apostille

January 23, 2023 by Admin

Do you need to obtain your Golden Visa for the country of Spain?  Have you been asked to apostille your documents for Spain?

A Golden Visa is a type of residence permit that allows non-European Union citizens to live in Spain for a certain period of time. To qualify for a Golden Visa, individuals must invest a certain amount of money in Spanish property, government bonds, or other financial assets. The specific requirements and investment amounts may vary depending on the type of Golden Visa being applied for. Once the visa is granted, the holder is generally able to live and work in Spain for a renewable period of five years, and may apply for permanent residency after five years.

It is possible to apply for permanent residency in Spain after living in the country for five years. Citizenship can be applied for after living full time for ten years. Although the temporary residency permit (the golden visa) can be easily renewed without living in the country, the route to both permanent residency and citizenship requires the investor and their family to reside in Spain. For this reason, the Spanish Golden Visa program is popular with those applicants who either wish to reside full time in Spain or simply maintain a second residency in Europe but without a path to citizenship. Investors looking for potential European citizenship are advised to consider the Portugal Golden Visa apostille program.

Spain is a member of the Hague Apostille Convention and any official document destined for this country requires an apostille from the Secretary of State’s office.  We can process documents issued from all 50 U.S. states, District of Columbia, and the U.S. Federal Government for the country of Spain.

The Portugal Golden Visa program is a residency by investment scheme designed for non-EU citizens.  Portugal launched the program in October 2012. Power of Attorney Apostille for the Philippines

January 8, 2023 by Admin

Do you need to apostille a Special Power of Attorney (SPA) for the Philippines?

The Philippines is a member of the Hague Apostille Convention.  Documents destined for the Philippines no longer requires the red ribbon or red seal from the Philippines Embassy or Consulate office.  The apostille issued by the Secretary of State is sufficient for the special power of attorney to be accepted in the Philippines.

A special power of attorney is a legal document appointing a specific representative (to be called an agent or attorney-in-fact) to act on behalf of another person who will be referred to as the principal.  The special power of attorney authorizes your agent/attorney in fact to do specific acts and functions for you in the Philippines.

In order to apostille the special power of attorney, it must first be signed and notarized.  Please meet with a local notary public before you mail in your documents for processing.

Below is an example of a Special Power of Attorney for the Philippines. You can ask the Philippines Consulate or Embassy for a sample or you can request one to be created for you by a professional in the Philippines (attorney).
