Apostille for Mexico

July 8, 2023 by Admin

Do you need to apostille documents originating from the U.S. and for Mexico?  Do you need to apostille a power of attorney for Mexico?

The most common documents we apostille for Mexico are: Birth certificates, death certificates, marriage certificate, Certificate of Naturalization, Certificate of Citizenship, FBI background checks, and a notarized power of attorney.

If you are planning to obtain dual-citizenship with Mexico, you will need to apostille your birth certificate.

Mexico is a member of the Hague Apostille Convention and any official document destined for this country requires an apostille from the Secretary of State’s office.  We can process documents issued from all 50 U.S. states, District of Columbia, and the U.S. Federal Government for the country of Mexico.

The purpose of the Hague Apostille Convention is to create a simplified method of “authenticating” documents for universal recognition.  An apostille certifies the official who signed your documents (Example: State official, County Clerk, Notary Public, Superior Court, FBI, U.S. Federal District Court, etc…)

Office Hours: Monday – Saturday 9am – 6pm

Special Power of Attorney from USA to Philippines

July 2, 2023 by Admin

Do you need to apostille an SPA for the Philippines?

A Special Power of Attorney (SPA) is a legal document that authorizes someone, known as the agent or attorney-in-fact, to act on behalf of another person, known as the principal, for specific tasks or transactions. If you are in the United States and need to grant a Special Power of Attorney to someone in the Philippines, you can follow these general steps:

  1. Consult with an attorney: It’s advisable to consult with a lawyer familiar with the laws of both the United States and the Philippines to ensure that the SPA meets the legal requirements of both jurisdictions.
  2. Draft the SPA: Work with your attorney to draft the Special Power of Attorney document. The document should clearly state that it is a Special Power of Attorney and specify the particular powers and responsibilities you wish to grant to the agent in the Philippines. These powers could include handling property transactions, managing bank accounts, representing you in legal matters, or performing other specific tasks.
  3. Include necessary details: The SPA should include your full name, address, and contact information as the principal, as well as the full name, address, and contact information of the agent or attorney-in-fact in the Philippines. Specify the duration of the authority granted, whether it is a one-time authorization or has a specific time period.
  4. Notarize the SPA: Once the document is drafted, it should be signed and notarized by a local notary public. Visit a notary public who can witness your signature and affix their seal or stamp to the document.  The second page of our order form has instructions for the notary public.
  5. Authenticate the SPA: To ensure the validity of the SPA in the Philippines, you will need to have an apostille attached.  For example, if your SPA is signed and notarized in California, you will need a California apostille.  If your SPA is signed and notarized in Texas, you will need a Texas apostille.
  6. Transmit the SPA: After the authentication is obtained, you can send the original document to your agent in the Philippines via a secure method, such as international courier or registered mail. It’s also a good idea to keep a copy of the SPA for your records.

Once the SPA is in the hands of your agent in the Philippines, they can act on your behalf within the specified powers and responsibilities mentioned in the document. Remember, the specific requirements and procedures may vary depending on the jurisdiction and the nature of the tasks involved. It’s always recommended to consult with legal professionals in both countries to ensure compliance with the applicable laws and regulations.
