Special Power of Attorney (SPA) Apostille for the Philippines

Do you need to apostille a Special Power of Attorney (SPA) for the Philippines?

On May 14, 2019, the Philippines joined the Hague Apostille Convention.  Documents destined for the Philippines no longer requires the red ribbon or red seal from the Philippines Embassy or Consulate office.  The apostille issued by the Secretary of State is sufficient for the special power of attorney to be accepted in the Philippines.

A special power of attorney is a legal document appointing a specific representative (to be called an agent or attorney-in-fact) to act on behalf of another person who will be referred to as the principal.  The special power of attorney authorizes your agent/attorney in fact to do specific acts and functions for you in the Philippines.

In order to apostille the special power of attorney, it must first be signed and notarized.  Please meet with a local notary public before you mail in your documents for processing.

Medical Exam Apostille

Do you need to apostille a Medical Exam or a letter from the Doctor’s office?

Have you been told to apostille a clean bill of health?  Are you planning on adopting or getting married in another country?  Are you planning to start a new job as a teacher or health care provider? Have you also been asked to apostille your birth certificate and an FBI background check?

In order to apostille a letter from the Doctor’s office, the Doctor’s signature will need to be signed and notarized.  If there is no notary on staff, you can hire a traveling notary to meet with the Doctor.

We can apostille medical letters signed and notarized in all 50 States and the District of Columbia.  In order to apostille this document, you will need to mail in the original signed and notarized letter with our order forms for processing.

For example, if your letter was signed and notarized in Texas, you will need to mail in the original with our Texas apostille order forms for processing.

Power of Attorney Apostille Services

Do you need a Power of Attorney Apostille?

We can apostille a power of attorney signed and notarized in all 50 U.S. States, District of Columbia, and the U.S. Federal Government (USA Embassies or US Consulates offices). For countries who are non-members of the Hague Apostille Convention, we can also process your power of attorney through Secretary of State, the U.S. Department of State and the Embassy or Consulate offices.

In order to apostille your power of attorney, you must mail in the original notarized copy to our office for processing.  A power of attorney can only be authenticated from the State the document was signed and notarized in. Please note that we do not accept electronic notarization.  The notary must be commissioned and include proper notarial wording for their State.

The Secretary of State does not have the authority to authenticate documents notarized in other States. For example, if your power of attorney was signed and notarized in the State of New York (NYC), the New York State is the only State that can issue the apostille.  Another example is if your power of attorney was signed and notarized in the State of Texas, only the State of Texas can issue the apostille.

Some States require a notarized document to also be authenticated by the County Clerk.  These States include: Hawaii, Kentucky, Maryland, New York, and Tennessee.

We recommend that your power of attorney be prepared by a professional from the Country requesting it. For example, if the Country of Mexico is requesting a signed and notarized power of attorney, we recommend that an attorney or paralegal in Mexico prepare your document both in English and Spanish.  Some US States will not apostille a document written in a foreign language.  In order to avoid this, we recommend your documents to be written in both languages.

If you are located outside of the USA and need to have your signed power of attorney authenticated for a country other than the USA, you can contact the local U.S. Embassy or U.S. Consulate office and meet with a U.S. Federal notary.  Be sure to schedule an appointment before you go there.  Once notarized, you can then mail in this document to our Washington DC apostille office for processing.

Please Note: We can only help you with documents originating from or notarized within the United States and for another country. If your power of attorney was signed and notarized in another country, you will need to contact the correct competent authority to assist you in that country.

Certificate of No Impediment for Marriage

Do you need to apostille a Certificate of No Impediment for Marriage?

Are you planning to get married in a foreign country this summer? Have you been asked to obtain an apostille on a Certificate of No Impediment for Marriage? This type of document is commonly knows as a Single Status Affidavit.  You can write one yourself or obtain one from the local County Clerk’s office.

Note: You will most likely be asked to obtain an apostille on your birth certificate and FBI background check.  We can help you with these documents too.

The most popular countries we can apostille or legalize a Certificate of No Impediment for Marriage are for: Vietnam, Cuba, Columbia, Argentina, Mexico, Brazil, Chile, Peru, Greece, Germany,  Philippines, Armenia and more.  From our experience, if you are planning to get married in a foreign country, you will be asked to obtain an apostille on your birth certificate, Single Status Affidavit, and an FBI background check.

We can apostille a single status affidavit issued from all 50 U.S. states, the District of Columbia (Washington DC), and the U.S. Federal Government.  The U.S. Embassy or Consulate located in a foreign country can also issue a single status affidavit (See sample below).  For countries who are non-members of the Hague Apostille Convention, we can also process your certificate of no impediment for marriage through the U.S. Department of State and the Embassy or Consulate office.

Certifying and legalizing documents for countries who are not members of the Hague Apostille Convention is a multi-step process. Embassy and Consulate Legalization Services

Here is an example of a Certificate of No Impediment for Marriage (AKA: single status affidavit):

The first step is to contact the local County Clerk’s office to request a document that states you are currently not married (AKA: Single Status Affidavit).  Some County Clerk offices may refer to this document as a “no record of marriage” instead of a “single status” (see list above of the different names).  Most all County Clerk offices can provide you this document so please be sure to speak to a supervisor/manager if you are told otherwise.  A document issued from the County Clerk’s office does not require notarization.

If the County Clerk is unable to assist you and you are in the United States, you can use the sample above to write your own Certificate of No Impediment for Marriage (AKA: single status affidavit).  Basically, you are writing a sworn statement stating that you are currently not married to another person in the United States.  Be sure to have this document signed and notarized before you mail it in to our office. You should also check with the people requesting your single status if they will accept a sworn affidavit directly from you.

If you are outside of the United States, the local US Embassy or US Consulate office should be able to assist you in completing this document.  Because you will be visiting a U.S. Federal Government office and having your document signed and notarized by a US Federal notary public, this document can then only be apostilled through our Washington DC apostille office.  Please note that U.S. Embassy and U.S. Consulate offices located outside of the United States are by appointment only and the U.S. Federal notary needs to be on site.
