Apostille for China

On November 7, 2023, China will join the Hague Apostille Convention.  Documents originating from the United States or notarized within the United States will only require the apostille issued by the Secretary of State’s office.

For example, if your birth certificate originates from California, On November 7, 2023 an apostille from the California Secretary of State is sufficient for this country.  Embassy or Consulate legalization will no longer be required.

What is an Apostille?

An Apostille (pronounced “ah-po-steel”) is a French word meaning certification.

An Apostille is simply the name for a specialized certificate, issued by the Secretary of State. The Apostille is attached to your original document to verify it is legitimate and authentic so it will be accepted in one of the countries who are members of the Hague Apostille Convention.

In the United States, all 50 states, the District of Columbia, and the Federal Government (US Department of State – Office of Authentication) can issue an Apostille.  In total, the United States can issue 52 different apostilles.

In 1961, many countries joined together to create a simplified method of “legalizing” documents for universal recognition. Members of the conference, referred to as the Hague Convention, adopted a document referred to as an Apostille that would be recognized by all member countries.

Since October 15, 1981, the United States has been part of the 1961 Hague Convention abolishing the Requirement of Legalization for Foreign Public Documents.

What is the Apostille Convention?

The Apostille Convention, or the Convention of 5 October 1961 Abolishing the Requirement of Legalization for Foreign Public Documents, is an international treaty that simplifies the process of authenticating public documents for use in foreign countries.

Currently, in order to use foreign documents in China for administrative purposes ranging from applying for a visa to establishing a business, a document needs to legalized through the State, US Department of State, and China Embassy (Legalization Process).  More information can be found by clicking the following link:  China Embassy and Consulate Legalization

US Department of State Office of Authentications Apostille

Do you need to apostille your documents through the US Department of State – Office of Authentications in Washington, D.C.?

The U.S. Department of State – Office of Authentications is physically located in Washington DC.  As of this article (April 2023), there is no walk in service and the current estimated processing time is 6-8 weeks.  In order to process your documents through the Department of State, you can either deal directly with them or utilize our services to assist you.

The US Department of State can issue an apostille on U.S. Federally-issued documents.  An example of federally-issued documents include:

  • Animal/Plant Certifications (issued by U.S. Department of Agriculture, or USDA)
  • Animal Health certifications (issued by USDA)
  • FBI – Background check (issued by U.S. Department of Justice, or DoJ)
    Do not notarize FBI background checks
  • U.S. Federal Court Documents check (issued by DoJ)
  • U.S. Bankruptcy Court check (issued by DoJ)
  • Immigration Certifications (issued by U.S. Department of Homeland Security)
  • Certificate of Foreign Governments (issued by U.S. Department of Health and Human Services, or HHS)
  • Certificate of Pharmaceutical/Export (issued by HHS)
  • Trademark (Issued by U.S. Patent and Trademark Office)
  • Other documents issued by Environmental Protection Agency, Social Security Administration, or Office of Personnel Management

State-issued documents for use in countries that are not members of the 1961 Hague Convention may be authenticated with an authentication certificate from the U.S. Department of State. Please note that a state issued document will first need to be certified through the state of origin before the US Department of state will certify it.

USCIS Form G24 Apostille

Do you need to apostille USCIS Form G24?  If your Certificate of Naturalization or Certificate of Citizenship is older than 20 years, we recommend that you certify the copy at the local U.S. Citizenship and Immigration Services (USCIS) office with form G-24.

USCIS Form G-24 is issued by the Department of Homeland Security – U.S. Citizenship and Immigration Services.  If the U.S. Department of State in Washington, D.C. has rejected your Certificate of Naturalization or you would like to send in a certified copy instead of the original to our Washington, D.C. apostille office, you will need to contact the local USCIS office to certify a copy of your document.

When a naturalized US citizen needs to have a Certificate of Naturalization “authenticated” by the U.S. State Department for use in a foreign country, the local USCIS can copy the document and certify it as a true copy. “Authentication” is a term used by the U.S. Department of State and other Governments to describe what USCIS refers to as Certified True Copies. When you require a Certificate of Naturalization to be authenticated, be sure to use the term “Certified True Copy.”

If you have the original document to be certified, you must make an appointment with your local USCIS office by using the InfoPass Appointment Scheduler. When you go to your appointment, be sure to bring your original naturalization certificate and a copy of it. Also bring another form of photo identification, such as a drivers license or passport. A USCIS officer will review the documents and may certify the copy, if the officer can confirm your identity and status as a naturalized citizen.

The U.S. Department of Homeland Security, U.S. Citizenship and Immigration Services, will provide Certified True Copies and return these along with the supplied documentation to the requester. USCIS cannot act as an agent of the U.S. Department of State by accepting fees on behalf of other government agencies, or forwarding documentation to any other government agency. All documentation coming from a requester, along with any documentation supplied by the Department of Homeland Security, will be returned to the requester.

Birth Certificate Apostille for the Bahamas

Do you need to apostille a U.S. birth certificate for the Bahamas?  Do you need to obtain dual citizenship in the Bahamas for your newborn baby who was born in the United States?

If your child was born in the Unites States (Example: Florida), you can mail in the birth certificate issued by the State Registrar or County Clerk for processing.  The birth certificate will need to be mailed in to our office with the completed order forms so we can obtain the apostille for the Bahamas.

Note: If your baby was born in Florida, the birth certificate is issued by the State Registrar.  To apostille a marriage certificate from Florida, this document is issued by the Circuit Court with a red seal.

AUTOMATIC BAHAMIAN CITIZENSHIP IS GIVEN TO PERSONS:

  • Born to an un-married Bahamian female in or outside of The Bahamas
  • Born outside of The Bahamas to a married Bahamian male who was not born outside The Bahamas

Please check with the Government of the Bahamas for detailed instructions.

The Bahamas is a member of the Hague Apostille Convention and any official document destined for this country requires an apostille from the Secretary of State’s office.  We can process documents issued from all 50 U.S. states, District of Columbia, and the U.S. Federal Government for the country of the Bahamas.

Driver’s License Apostille for Portugal

Do you need to apostille your US Driver’s License for a Portuguese Driver’s License?  Have you been told that you can drive in Portugal if you notarize and apostille a color copy of your driver’s license?

If you have a valid driver’s license and want to exchange it for a Portuguese driver’s license, you may be able to do so by following these steps:

  1. Check if your driver’s license is valid in Portugal: The Portuguese government allows certain foreign driver’s licenses to be exchanged for a Portuguese driver’s license. Check the official website of the Portuguese Immigration and Borders Service (SEF) to see if your driver’s license is eligible.
  2. In order to obtain an apostille on your driver’s license, you will need to make a color copy of your driver’s license and meet with a local notary public.  Depending on the state, either the notary will copy certify your license or you will need to attest to it’s authenticity with a sworn statement and signature.  The notary will then notarize the document.  Mail in your notarized color copy with our order forms for processing.  Do not mail in the original driver’s license.
  3. Gather other necessary documents: You will need to provide other documents, such as proof of residence in Portugal, proof of identity, and proof of payment of fees.  You may also need to apostille your FBI background check for Portugal.
  4. You can submit your application to exchange your California driver’s license for a Portuguese driver’s license at any Portuguese driving license office. You will need to provide all the required documents and pay the applicable fees.
  5. Pass a driving test (if necessary): Depending on your age, driving experience, and the type of vehicle you want to drive, you may need to pass a driving test to obtain a Portuguese driver’s license.

It’s important to note that the process for exchanging a foreign driver’s license for a Portuguese driver’s license can vary depending on the specific circumstances of each individual. Therefore, it is recommended to consult with the local authorities or a legal professional for further guidance.
