Orange County California Single Status Apostille

Do you need to apostille a single status from California?  Are you located in Orange County, California and need a document that proves you are currently single and not married?

Note: If you are located in Los Angeles County, please contact the Orange County Clerk’s office for instructions on how to obtain the single status. The Los Angeles County is currently not providing this document.

If you are planning to get married in another country who is a member of the Hague Apostille Convention, you will be asked to apostille a document called a single status affidavit.  In some countries, you may also be required to provide this documentation for employment.

Here is an example of a single status issued by the Orange County Clerk’s office in California:

The first step is to contact the Orange County Clerk’s office to request a document that states you are currently not married (AKA: Single Status).  

If you are outside of the United States, the local US Embassy or US Consulate office should be able to assist you in completing a single status and also having it signed and notarized.  Because you will be visiting a U.S. Federal Government office and having your document signed and notarized by a US Federal notary public, this document can then only be apostilled through our Washington DC apostille office.

Here is an example of a Single Status Affidavit / Affidavit of Civil Status issued from a U.S. Embassy / Consulate General:

Vietnam Embassy Attestation and Legalization

Do you need Vietnam Embassy attestation and legalization services?

Vietnam is not a member of the Hague Apostille Convention (Convention of 5 October 1961 Abolishing the Requirement of Legalization for Foreign Public Documents).  Documents originating from the USA and destined for Vietnam requires several steps to complete. These steps are necessary in order for the country of Vietnam to accept your documents.

Processing documents for Vietnam is a multi-step process commonly referred as the Legalization Process.  Here is an illustration to help explain the process:

Apostille a Power of Attorney

Do you need to apostille a power of attorney?

We offer apostille services for power of attorney documents that have been signed and notarized in all 50 U.S. states, the District of Columbia, and the U.S. Federal Government (USA Embassy/USA Consulate). For countries that are not part of the Hague Apostille Convention, we can assist you in processing your power of attorney through the U.S. Department of State and the Embassy or Consulate office.

To obtain an apostille for your power of attorney, you need to send the original notarized copy to our office for processing. Please note that a power of attorney can only be authenticated by the state in which it was notarized. The notary must be commissioned and include the appropriate notarial wording for their respective state.

The Secretary of State does not have the authority to authenticate documents notarized in other states. For instance, if your power of attorney was signed and notarized in California, only California can issue the California apostille. Similarly, if your power of attorney was signed and notarized in New York, only New York can issue the New York apostille.

Certain states may require a notarized document to be further authenticated by the County Clerk. These states include Hawaii, Kentucky, Maryland, New York, and Tennessee.

We highly recommend having your power of attorney prepared by a professional in the country that is requesting it. For instance, if Mexico requires a signed and notarized power of attorney, it is advisable to have an attorney or paralegal in Mexico prepare the document in both English and Spanish. Some U.S. states do not apostille documents written in a foreign language, so it is best to have your documents in both languages to avoid any issues.

If you are located outside of the USA and need to have your signed power of attorney authenticated for a country other than the USA, you can contact the local U.S. Embassy or U.S. Consulate office to meet with a U.S. Federal notary. Once notarized, you can then mail the document to our Washington DC apostille office for processing.

Please be aware that we can only assist you with documents that originate from or are notarized within the United States and are intended for use in another country. If your power of attorney was signed and notarized in a different country, you will need to contact the competent authority in that country for assistance.

Same Day Apostille

Do you need Same-Day Apostille Services?

Prior to the start of the pandemic, we were able to apostille your documents as fast as the same-day.  For example, we were able to apostille documents from California, New York (NYC), Illinois, Maryland, Florida, and the District of Columbia (Washington, D.C.) in one business day.  In California, if we received your documents by 10:30am, we were able to apostille them the same-day through the California Secretary of State’s office and overnight them to you by FedEx or UPS.

Since March 2020, there are have been significate delays in completing documents through the Secretary of State’s office and U.S. Federal Government (U.S. Department of State).  For example, the processing time through the US Department of State for the FBI background check apostille took as little as four business days prior to the pandemic.  Now it’s eight to twelve weeks or longer.  Processing documents issued from NYC use to take one business day prior to the pandemic. Now it can take two months if your document originates from New York County.  As of this article, the County of New York processing time is 4-6 weeks.

These unprecedented delays have caused sever disruption in peoples lives making it harder to authenticate U.S. documents for foreign use.  As a result, delays have caused lost employment, dual citizenship delays, business deals, delays in destination weddings, retirements, etc…

Most foreign countries including their respective Embassy or Consulate office in the United States understand that there are delays in completing certain types documents.  Therefore, measures have been put into place to accommodate these delays.

Beware of websites that ask you to upload your documents to a company located in New York or a company providing online notarization.  

In order to alleviate the pressures of completing documents within a specific time, we recommend that you take a proactive approach in authenticate your documents.  Our current estimated processing time is located here: Apostille Processing Time

Type of Documents: We recommend that you consult with your contact in the foreign country or the Embassy or Consulate offices located in the United State for a list of documents you will need to apostille.  Unfortunately, we cannot advise you because every situation is unique and the requirements can change at any time.  For example, if you need a single status apostille, we recommend that you find out if you also need to apostille your birth certificate.

Mail In Your Documents: Mail in the documents you want us to process. Do not mail in documents you don’t want us to process. For example, if you only want us to apostille one birth certificate, do not send in two.  We are unable to obtain originals or certified copies and can only process what you mail in.  Please mail in the originals issued by the County, Court, State, or US Federal Government.  Do not mail in xerox black and white or color copies of your vital record documents.  Do not mail in a laminated document. If for some reason we are unable to process your documents, we will contact you with instructions by email and phone.

Divorce Decree Apostille

Do you need to apostille a Divorce Decree?

In order to apostille a divorce decree, you will need to contact the Court and obtain a certified copy.  A certified copy will be signed and stamped by the Court.

To obtain a copy of your divorce decree from the court, you can follow these general steps:

Determine the court: Identify the specific court where your divorce case was handled. This is typically the court in the jurisdiction where you and your former spouse resided during the divorce proceedings.

Contact the court clerk’s office: Reach out to the clerk’s office of the court where your divorce was finalized. You can do this by phone, email, or in person. Provide them with the necessary information, such as your full name, your former spouse’s full name, and the date of the divorce.

Verify the requirements: Ask the court clerk about the specific requirements for obtaining a certified copy of your divorce decree. They may ask you to provide additional information or documentation, such as your identification or case number, to ensure they locate the correct records.

Submit a request: Follow the instructions provided by the court clerk to request a certified copy of your divorce decree. This may involve completing a form or submitting a written request. Some courts may also have an online portal where you can request copies of court documents.

Pay any fees: Inquire about any fees associated with obtaining a copy of the divorce decree. Courts often charge a nominal fee for document retrieval or copying services. Be prepared to make the payment, if required, either in person or through an accepted payment method.

Wait for processing: The court clerk will process your request, locate the divorce decree in their records, and make a copy for you. The processing time may vary depending on the workload of the court.

Collect your copy: Once the court has processed your request, you can collect your certified copy of the divorce decree. Confirm with the court clerk whether you need to pick it up in person or if they can mail it to you. In some cases, courts may also provide electronic copies.

The final step is to mail in your certified copy with our apostille order forms for processing.
